2. Collection, Storage and Erasure of Personal Data as well as Type and Purpose and their use:

a. When visiting the website:
When you visit our website https://www.unger.de/ the browser you are using on your terminal device automatically sends information to the server of our website. This information will be temporarily stored in a so-called log file. The following information will be recorded without your intervention and stored until automated deletion:
  • IP-IP address of the requesting computer,
  • date and time of access,
  • name and URL of files accessed,
  • website from which access has been made (Referrer-URL),
  • the browser used and, if applicable, your computer´s operating system, and your access provider´s name.
We will be processing the above-mentioned data for the following purposes:
  • ensuring a smooth connection of he website,
  • ensuring comfortable use of our website,
  • evaluation of system and stability,
  • for other administrative purposes.
The processing of personal data when accessing our website also includes the transmission of the aforementioned data to our hosting provider ScaleCommerce GmbH, Horstweg 24, 14059 Berlin. The legal basis for this processing is Article 6 para 1 lit. f GDPR. Our legitimate interest follows from the purposes listed above. In no case we will use the collected data for the purpose of drawing conclusions about your person.

b. E-Mail-Newsletter:
If you have expressly consented in accordance with Article 6 para 1 lit. a GDPR, we will use your email address to regularly send you our newsletter. To receive the newsletter, it is sufficient to provide an email address.
Furthermore, we use the email address you provide in the context of a contractual relationship to send you information about our products, services and special offers by newsletter, only if you are one of our existing customers. In this case, the newsletter is sent on the basis of our legitimate interest in direct advertising to existing customers in accordance with Article 6 para 1 lit. f GDPR.

When sending the newsletter, so- called Web Beacons (see section 4) are used. These enable us to analyse the success of the newsletter by using key figures such as clicked links to analyse and to optimize our offering using the knowledge we gained this way. Your data will only be passed on to third parties for the technical processing of the newsletter dispatch via a service provider. This service provider complies with data protection regulations and enables us to send and analyse our newsletter.

c. When subscribing to our WhatsApp messages:
We offer you the opportunity to register for our WhatsApp messages on our website. You will receive messages about our offers via WhatsApp to the telephone number you have provided, so you can ask us questions about products. If you have explicitly consented to this in accordance with Article 6 para 1 lit. a GDPR, we will use your first and last name, your telephone number and Messenger-ID, your profile picture and the message history in order to be able to offer you this service. An active WhatsApp account is required to use this messenger service. In this context, WhatsApp Ireland Limited also processes your data. We are not responsible for this data processing. d. Ordering process:
To record, process and carry out your order, your data will be forwarded to service providers, for example the delivery of the goods, where necessary. We only forward the personal data that is required for delivery (name and address of the recipient). The legal basis for data processing is Article 6 para 1 lit. b GDPR.

If you give us your consent in accordance with Article 6 para 1 lit. a GDPR during the ordering process, we will also forward your email address to the shipping service provider so that they can offer you additional services (e.g. delivery notification, selection of a different delivery date or drop-off location). In particular, you have the option of using the pick ware service, which uses a Google Maps API connection (see below for more information on Google Maps), to find the nearest packing station for your delivery. Your consent is not required for the conclusion of the contract and is valid until revoked, which you can declare at any time with effect for the future, e.g. by email to [email protected].

Payment data is collected in encrypted form and used exclusively to process the corresponding transaction. Except for payment by purchase on account, Unger has no knowledge of or access to the bank and credit card details. Processing is carried out exclusively by the relevant service provider. If you select the respective payment option, you personal data may be transmitted to Klarna Bank AB (publ), Chausseestraße 117, 10115 Berlin, or to PAYONE GmbH, Lyoner Straße 15, 60528 Frankfurt am Main, who acts for us in this context as contract processor bound by instructions. As a registered customer, you can select the "Save payment data" option during the ordering process. This means that sensitive credit card data can be stored securely and easily using a so-called "alias" (token) in your customer account for future purchases.You can manage or delete the saved information under "My customer account" at "My payment details". If you do not want to save a credit card in your profile, you can enter the data again for each order.

e. Credit assessment:
In cases in which we make delivery before payment, e.g. in the case of a purchase on account as part of the “UNGER Fashion Concierge Selection”, we regularly check your creditworthiness and in certain cases, in which there is a legitimate interest, also the creditworthiness of existing customers. For this purpose, we cooperate with Creditreform Boniversum GmbH, Hammfelddamm 13, 41460 Neuss, from which we receive the required data. For this purpose, we transfer your name and your contact data to Creditreform Boniversum GmbH. In the event of receivables overdue for a prolonged period, your data will be transmitted to Creditreform Boniversum GmbH, as collection agency for the purpose of asserting claims in Germany and will be used there. f. Customer account registration data:
Within the order process you have the opportunity to set up a customer account with us (e.g. during the ordering process). Your address data including e-mail address and orders are stored here. The personal data is collected and processed to the extent required in accordance with Article 6 Para. 1 S. 1 lit. b GDPR

When you order the next time, all you have to do is enter your user name and a password. The Password must be kept secret.

g. Erasure of data:
Your data stored by us will only be stored for as long as it is required.
  • The data of the customer account will remain stored until you cancel the account.
  • Without a customer account the order data remain stored until completion of the order.
Then the data will be erased, unless there are legal storage obligations to keep it. Data that we need to complete outstanding tasks or to assert our rights and claims, as well as data that we must keep in accordance with legal requirements, are excluded from erasure. In this case, the data is blocked for further processing.

3. Disclosure of Data to Third Parties:
Your personal data will not be transmitted to third parties for purposes other than those listed below. We only pass on your personal data to third parties:
  • if you explicitly have consented pursuant Article 6 para. 1 sentence 1 lit. a GDPR,
  • if passing on your personal data pursuant Article 6 para. 1 sentence 1 lit. f GDPR is necessary for assertion, exercise or defence of legal claims, and there is no reason to believe that you have an overriding interest worthy of protection in non-disclosure of your data,
  • in the event of a legal obligation existing for their transfer pursuant to Article 6 para. 1 sentence 1 lit. c GDPR, and
  • this is permitted by law and it is necessary for carrying out our contractual relationships with you pursuant to Article 6 para. 1 sentence 1 lit. b GDPR.

4. Cookies & Web Beacons:
We use Cookies and Web Beacons on our website. Cookies are small files that are automatically created by your browser and stored on your terminal device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your terminal device and do not contain any viruses, Trojans or other malware. Information is stored in the cookie that is related to the specific terminal device used. However, this does not mean that we gain direct knowledge of your identity.

Web Beacons are invisible graphics used to collect information. Web Beacons can be used to evaluate visitor traffic on websites.

The use of cookies and Web Beacons serves different purposes. Some of them are necessary for the operation of the website. They serve to enable you to use our offer. 5. Analyse-Tools and Marketing:
a. Google Analytics:

We use Google Analytics, a web analysis service by Google Ireland Limited (Gordon House Barrow Street, Dublin 4; hereinafter „Google“) for the purpose of demand-oriented design and continuous optimization of our sites.

In this context, pseudonymised user profiles will be created and cookies will be used, see section 4. The information on your use of our website created by the cookie such as
  • browser type/ version,
  • used operating system,
  • Referrer URL (the previously visited page),
  • the accessing computer’s host name of (IP address),
  • time of server request,
will be submitted to a server of Google in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on the website activities and to provide further services associated with the use of the website and of the internet for the purposes of market research and demand-oriented design of these web pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company. Under no circumstances will your IP address be merged with other data from Google. The IP addresses will be anonymized so that an assignment is not possible (IP masking).

b. Google Tag Manager:
We also use Google Tag Manager in connection with Google Analytics and other analysis tools. This is an organizational tool that enables us to centrally manage code sections of various tracking tools that we use on our website. Google Tag Manager does not carry out any independent analyses, does not store any cookies and does not create any user profiles. Its use and the associated data processing are technically necessary in order to be able to technically implement your consent to the use of individual analysis tool, and thus also for the presentation of our website.

c. Google Ads Pixel:
In addition, we use Google Ads Pixel from Google Ireland Limited (Gorden House, Barrow Street, Dublin 4, Ireland) on our website. This is a technology that we use to measure the success of our advertisements on Google (Google Ads). When you visit our website, a direct connection will be established via the pixel between your browser and the Google server. This means that Google receives among other things, information from your browser, that our website has been visited from your device. As the provider of the pages, we only have very limited knowledge of the content of the data transmitted and how Google uses it. We can only select which segments of Google users (such as age, interests) our advertising should be displayed to. d. Google Remarketing:
This website uses Google Remarketing, a retargeting service from Google, to collect and store data from which user profiles are created using pseudonyms. This technology allows users who have already visited our websites and online services to see targeted advertising from us on other external sites in the Google Partner Network. A cookie is placed on your computer to analyze user behavior when visiting the website and can then be used for targeted product recommendations and interest-based advertising.

e. Facebook-Pixel:
Our website uses the services Facebook Pixel. These are products of Facebook Ireland Limited (4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland). These services document the transactions on our website, such as the time spent on pages, the placement of products in the shopping cart or purchases. f. Microsoft Advertising:
We use the Convention-Tracking-Tool Microsoft Advertising from Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA, to find out more about the user behaviour on our website.

By integrating a conversion tracking tag on our website, we can find out which keyword or search engine ad the user uses to come to our website. Microsoft Advertising also enables us to analyze how many users come to our website via Microsoft Ads, which subpages they visit and how long they stay on the website. We only receive data or evaluations of users' web behavior via Microsoft Advertising and no personal data.

Microsoft uses this data to improve its own website. If you have a Microsoft account, the data collected may be linked to it.

Our website uses Shopware Analytics, an analysis tool from Shopware AG (Ebbinghoff 10, 48624 Schöppingen, Germany). This tool helps us to better understand the behavior of users on our website and to improve our content and offers in a targeted manner.

For this purpose, personal data about your visit to our website is processed, e.g. your visit duration, page views and click behavior, as well as technical information about the device you are using (e.g. browser type, operating system, screen resolution, IP address).

h. econda:
For the purpose of web analysis and website tracking, we use technology from econda (econda GmbH, Zimmerstr. 6, 76137 Karlsruhe, Germany) on our website. econda analyses and collects transaction data for marketing purposes in order to offer personalised content. For this purpose, econda stores "1st party cookies" on your terminal device, which means that the processed data originates exclusively from our website.

With this data, pseudonymised user profiles are created, evaluated and used to address you with appropriate advertising based on your user behaviour. Enconda helps us to analyse the use of our website and to further develop it in terms of user-friendliness.

When using econda, the pseudonymised data can in no way be used to personally identify the visitor to the website.

i. Hotjar:
We use "Hotjar" on our website, a web analysis service provided by Hotjar Ltd., Level 2, St Julian's Business Centre, 3, Elia Zammit Street, St Julian's STJ 1000, Malta (hereinafter: "Hotjar"). Hotjar uses cookies that are stored locally in the cache of your web browser on your device and that enable an analysis of your use of our website, as well as a so-called tracking code. The cookies used by Hotjar are stored on your device for different lengths of time, sometimes only during your visit, sometimes for 365 days. j. Mable:
To control the data streams on our website, we use the tool “Mable” from the provider Mable GmbH, Kaiserstraße 88. 76133 Karlsruhe.

In this context, pseudonymized usage profiles are created and cookies (see under point 4) are used. The following data from website-users are processed:
A pseudonymous user recognition, Visitor behaviour on the website (Visitor behaviour includes, among other things, data about where visitors come from, which areas of a website are visited and how often and for how long which sub-pages and categories are viewed).

This data may be added to information stored in your user account or collected during the ordering process, regardless of whether the purchase has been completed.

Mable enables us, in the interest of users and in our own interest, to better control out data flows and to decide and regulate which data is passed on to third parties. It also allows us to independently evaluate these data according to our own criteria. When we work with certain partners, e.g., for online marketing purpose, in many cases this requires the integration of code components that cause a direct server connection and the collection of personal data from our website-users by this partner. In this case, we often have no influence on the exact data collection or on the data flows. Mable allows us to use programs from partners without integrating their code into our website. In this case, a direct server connection to the website-users by the third party is not necessary. k. Criteo:
We also use the Retargeting-Tool Criteo (Criteo GmbH, Gewürzmühlstr. 11, 80538 München). Criteo collects information about the surfing behaviour of website visitors in an anonymous form for marketing purposes. Cookies are used for this purpose.

Criteo can analyze surfing behavior and then display targeted product recommendations as a suitable advertising banner when other websites are visited. The anonymized data can´t be used to personally identify the website visitor. The data collected by Criteo is only used to improve the advertising offer. On each banner displayed there is a small "i" (for information) in the bottom right, which opens when you mouse over it and, when clicked, leads to a page where the system is explained and an opt-out is offered. When you click on opt-out, an "opt-out" cookie is set, which prevents these banners from being displayed in the future. It is not used for any other purpose or passed on to third parties.

I. WisePops:
We use the service of WisePops SAS, 87 Boulevard Suchet, 75016 Paris, to send surveys to our users. WisePops uses cookies (Section 4.) to determine whether and how users interact with the survey pop-ups. We use these survey results to optimize the website.

m. Webgains:
We participate in the Webgains affiliate program of ad pepper media GmbH, Frankenstraße 150c, Franken Campus, 90461 Nürnberg. To document transactions (e.g. leads and sales), Webgains stores cookies of the end device of users who visit its customer´s website or use their online offers (e.g. registering for a newsletter or ordering in an online shop). The cookies used only serve the purpose of correctly allocating the success of an advertising medium and the associated commission calculation.

The cookie only contains information about when and which action (click or view) was carried out by the user on a specific advertising medium. Webgains also collects information about the end device, such as the operating system and the browser used. However, the tracking cookies do not allow any conclusions to be drawn about individual users.

If you do not want cookies to be stored in your browser, you can achieve this by setting the browser accordingly. Please note that in this case you must expect a limited presentation of the online offer.

n. FACT Finder:

p. emarsys:

6. Social-Media:
Our website offers the option of sharing content on the social media networks Facebook and Pinterest. We integrate these plug-ins using so.called two-click method in order to protect the visitors to our website as best as possible. The legal basis for transmitting is Article 6 Para 1 S. 1 lit a GDPR. You give your consent by making the mentioned two clicks on the respective button.

7. Miscellaneous:
a. FRAEND:
We use FRAEND (FRAEND GmbH; Gaudystr. 10; 10437 Berlin; Deutschland) on our website to enable user registrations and user logins via the OAuth2.0 authorization protocol. You will only take part in such a user registration or login if you log in via a user account with us, with FRAEND or with another service such as Facebook or Google (in the latter case, these services can theoretically also monitor your use of FRAEND track). We use the web monitoring platform Pingdom from SolarWinds Worldwide, LLC 7171 Southwest Parkway, Bldg 400, Austin, Texas 78735. This analyses our website in terms of transactions, loading times and availability in order to improve the user experience and enable us to respond quickly to problems. The following data is processed when a page is accessed:
  • Browser-Typ/-Version,
  • Operating system used,
  • Features that provide information about the context in which the page is accessed and how the page is loaded and asynchronously reloaded,

  • Time of the server request.
We use this web monitoring platform to improve the performance of our website and to enable digital web management. This serves a legitimate interest in accordance with Article 6 Para 1 S. 1 lit f GDPR.

8. Rights of Data Subjects:
You have the right:
  • to obtain access to your personal data processed by us in accordance with Article 15 GDPR. In particular, you may obtain access to the purposes of the processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed,the envisaged storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the source of your data, if these have not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information on their details;
  • to request the immediate rectification of inaccurate or completion of incomplete personal data stored by us in accordance with Article 16 GDPR;
